Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Proveya (“Proveya”, “we”, “us”) governing your use of the Proveya mobile application and this website (together, “the Service”). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use Proveya.

Your privacy is covered separately in our Privacy Policy, which forms part of these Terms.

1. Who can use Proveya

You must be at least 13 years old, or older if the minimum age of digital consent where you live is higher. If you are under the age of majority in your country, you may only use Proveya with the involvement of a parent or guardian. Proveya is not directed at children under 13 and we do not knowingly allow them to create accounts.

You may not use the Service if you are barred from doing so under any applicable law, or if we have previously terminated your account.

2. Your account

  • You can sign up with an email address and password, with Google, or with Sign in with Apple. You are responsible for keeping your credentials secure and for everything that happens under your account.
  • Provide accurate information, and keep your contact details current so we can reach you.
  • One person, one account. Don't create accounts to evade a suspension or to impersonate someone.
  • Tell us promptly at proveya.info@gmail.com if you believe your account has been compromised.

3. Proveya is a game — not gambling

Proveya is a free prediction game played for entertainment. To be completely explicit:

  • There is no wagering, staking, buy-in, entry fee, deposit or cash-out of any kind.
  • Points, levels, badges and leaderboard positions have no monetary value, cannot be purchased, sold, transferred or exchanged, and confer no prize or thing of value.
  • We do not process payments and do not offer in-app purchases or subscriptions.

Any arrangement you make privately with other people off the platform is entirely your own responsibility and nothing to do with Proveya.

4. Content you create

You keep ownership of the events, predictions, text and images you create (“Your Content”). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display Your Content for the sole purpose of operating and providing the Service. This licence ends when you delete the content or your account, except for copies retained in backups for a limited period or where we must keep them by law.

You are responsible for Your Content. Only post content you have the right to post, and remember that content you create in a shared event or tournament is visible to the other participants.

5. Acceptable use and objectionable content

We have no tolerance for objectionable content or abusive behaviour. You agree not to create, post, share or transmit content that:

  • Harasses, bullies, threatens, defames or intimidates any person.
  • Promotes hatred or violence against people based on race, ethnicity, national origin, religion, disability, age, sex, gender identity or sexual orientation.
  • Is sexually explicit, pornographic, or sexualises minors in any way.
  • Depicts or glorifies graphic violence, self-harm or cruelty.
  • Is illegal, promotes illegal activity, or facilitates real-money gambling.
  • Infringes anyone's intellectual property, privacy or other rights.
  • Is spam, a scam, deliberately deceptive, or impersonates another person or organisation.
  • Contains malware, or attempts to breach, overload, scrape or reverse-engineer the Service.

6. Reporting, moderation and enforcement

To report objectionable content or an abusive user, email proveya.info@gmail.com with the username involved and, where relevant, the event it appeared in, so we can find it quickly.

We review every report and act on it within 24 hours of receiving it: we remove content that breaches these Terms and we eject the user who provided it. Depending on severity we may issue a warning, remove content, suspend an account, or terminate it permanently. Serious matters may be referred to law enforcement.

7. Event results and availability

Events linked to real fixtures are resolved using third-party sports data, which we do not control and cannot guarantee is accurate, complete or timely. Other events are resolved by the user who created them. We provide the Service on an “as is” basis and do not warrant that results, scoring or availability will be uninterrupted or error-free. We may change, suspend or discontinue any part of the Service.

8. Ending your use

You can stop using Proveya and delete your account at any time from Settings → Account → Delete account in the app, or via our account deletion page. We may suspend or terminate your account if you breach these Terms, if required by law, or if your conduct risks harm to other users or to the Service.

9. Disclaimers and liability

To the fullest extent permitted by law, Proveya is provided without warranties of any kind, express or implied. We are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law — including, for consumers in the EEA and UK, your statutory rights.

10. App Store terms

If you downloaded Proveya from the Apple App Store, you acknowledge that these Terms are between you and Proveya only, not with Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Proveya — not Apple — is responsible for addressing any claims relating to the app, including product liability, legal or regulatory non-compliance, and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government restricted-parties list.

11. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version here with a new “Last updated” date and, where the change is material, notify you in the app. Continuing to use Proveya after a change means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of the country in which Proveya is established, without regard to its conflict-of-law rules. If you are a consumer in the EEA or UK, you keep the protection of the mandatory consumer-law provisions of the country in which you live, and you may bring proceedings in your local courts.
